These Terms and Conditions ("Terms") explain how you can use the website boomigo.in ("Website") and its services, operated by Boomigo Cart LLP ("Boomigo," "we," "us," or "our"). These Terms apply to all visitors, users, and others who access or use the Website, including both customers and vendors.

By using our Website, you agree to these Terms. If you don't agree, please don't use the Website.

  1. Your Agreement

1.1. These Terms are a binding legal agreement between you and Boomigo.

1.2. By using the Website, you confirm you've read, understood, and agree to these Terms and any related policies.

1.3. We may update these Terms by posting changes on our Website. It's your responsibility to check for updates. Your continued use means you accept the changes.

2.1. Boomigo.in is an online marketplace connecting buyers with independent sellers ("Vendors") of unique, authentic, and homegrown products from Kerala. This includes spices, oils, foods, crafts, books, and more.

2.2. We are a platform, not the manufacturer. While we aim for quality, Vendors are directly responsible for their products.

  1. Your Account

3.1. You might need an account to use some Website features.

3.2. Keep your account details (username, password) safe. You're responsible for all activity on your account. Tell us immediately if you suspect unauthorized use.

3.3. We can refuse service, close accounts, or cancel orders at our discretion.

  1. Shopping on Boomigo.in (For Customers)

4.1. Product Info & Prices:

  1. Vendors provide all product details, images, and prices. We try for accuracy, but don't guarantee all information is perfect.
  2. Prices usually include GST. In case of no free shipping, the Shipping costs are extra and will be shown at checkout.
  3. We can correct errors or cancel orders if information is wrong, even after you've ordered.

4.2. Ordering:

  1. Your order is an offer to buy from the Vendor via Boomigo.
  2. All orders need approval from the Vendor and Boomigo. An order confirmation means we received it, not that it's accepted.
  3. Your purchase contract is complete when the Vendor ships your product.

4.3. Payments:

  1. Pay using methods shown on the Website (cards, net banking, UPI, etc.).
  2. Payments are processed securely by third parties. We don't store your financial details.
  3. Provide accurate payment and account information for all purchases.

4.4. Shipping & Delivery:

  1. Delivery times are estimates and vary by Vendor, product, and location.
  2. We deliver to your specified address. You must provide correct details.
  3. We are not liable for delivery delays due to events beyond our control (e.g., natural disasters).

4.5. Returns, Refunds, and Cancellations:

  1. Our separate Returns & Refunds Policy applies. Please read it.
  2. Products must generally be returned unused, in original packaging. Some items (like food) may not be returnable.
  3. Refunds are processed according to our policy and may take time.
  1. Selling on Boomigo.in (For Vendors)

5.1. Vendor Agreement: If you want to sell, you'll sign a separate Vendor Agreement with Boomigo, outlining terms for listings, orders, payments, and more.

5.2. Product Compliance & Liability: Vendors are solely and directly responsible for the quality, authenticity, safety, and legality of all products listed and sold. This includes any claims of forgery, defect, misrepresentation, or non-compliance. Vendors shall remain fully liable for any such issues, whether addressed through company procedures or escalated to legal proceedings.

5.3. Authenticity: You must guarantee your products are authentic as described. Misleading information will lead to immediate account termination and potential legal action.

5.4. Order Fulfillment: Vendors must process, pack, and ship orders on time, following Boomigo's rules.

5.5. Customer Service: Vendors need to help customers with product questions, by working with Boomigo.

5.6. Prohibited Items: Do not sell illegal or harmful items.

5.7. Taxes: Vendors are responsible for all their own taxes related to sales on Boomigo.

  1. Your Behavior & Content

6.1. Don't do this: Don't use the Website illegally or in ways that break these Terms, such as:

  1. Harassing or discriminating against others.
  2. Giving false information.
  3. Uploading viruses.
  4. Stealing personal data.
  5. Spamming or scraping our site.
  6. Breaking our security.
  7. Using the site for bad purposes.

6.2. What you post (Reviews, Comments):

  1. You can post comments and reviews, but they must be lawful and not harmful, offensive, or infringe on others' rights.
  2. You give Boomigo permission to use your posted content (e.g., in marketing).
  3. You confirm you own the content you post and that it's accurate and won't harm anyone.
  4. We can monitor, edit, or remove content.
  1. Our Rights (Intellectual Property)

7.1. All Website content (text, images, logos, etc.) belongs to Boomigo, its Vendors, or suppliers, protected by Indian and international copyright laws.

7.2. Boomigo's name and logo are our trademarks. Don't use them without our permission.

7.3. You can link to our homepage, but not in a way that is false or offensive.

  1. Disclaimers & Limits on Our Responsibility

8.1. We don't promise uninterrupted, timely, secure, or error-free service.

8.2. Boomigo (and its staff) is not liable for any injury, loss, or damages (like lost profits, data loss) from your use of the service or products. This applies whether it's a contract issue or not.

8.3. As an intermediary, our liability for products purchased on the platform is limited by Indian law. The Vendor is primarily and ultimately responsible for product quality, defects, or misrepresentation as per Section 5.2.

  1. Your Responsibility (Indemnification)

You agree to protect Boomigo (and our team) from any claims or costs (including legal fees) that arise from you breaking these Terms, breaking any law, or violating someone else's rights.

  1. If a Term is Invalid

If any part of these Terms is found to be illegal or unenforceable, that part will be removed, but the rest of the Terms will still apply.

  1. Ending This Agreement

11.1. Your responsibilities before termination still apply afterwards.

11.2. You can end these Terms by stopping use of our Services.

11.3. We can end these Terms immediately without notice if you break them, and you'll still be responsible for any amounts owed. We might also block your access.

  1. Laws and Disputes

12.1. These Terms and any related agreements are governed by the laws of India.

12.2. Any disputes will be handled exclusively by the courts in Ernakulam, Kerala, India.

  1. Full Agreement

These Terms, along with any policies on our site, are the full agreement between you and us, replacing any past agreements.
